Equine Industry Effected by the ACT 38 Regulations!

As of October 1, 2008

Equine is regulated by ACT 38

Which Equine Farms will be Regulated?

Private and Commercial Farms meeting the following Criteria.

CAO (Concentrated Animal Operation)

High Density Livestock Operations

8 AEUs (Animal Equivelant Units)

> 2000 lbs animal live weight per acre.

Examples:

5 Horses on 2 acres (5000 lbs/2 acres=2500lbs per acre)

High Density, but not > 8000 lb- NOT a regulated CAO.

9 Horses on 5 acres (9000 lbs/5 acres= 1800 lbs per acre)

 > 8000 lb, but not high density- NOT a regulated CAO.

10 Horses on 4 acres (10000 lbs/4 acres=2500lbs per acre)

 > 8000 lb and high density - This is a regulated CAO.

 

Facility Odor Management

Effective February 27, 2009

Who is regulated?

New and Existing CAO and CAFO(Concentrated Animal Feeding Operations) And New Construction Activities

Animal Housing and Manure Storage Facilities

Odor Management Plan only required to address

New facility or Newly Constructed Portion of an expanded facility
